@article{أثر القانون الدولي في نشوء الدساتيـــر_2025, volume={42}, url={https://journal.muc.edu.iq/journal/article/view/660}, abstractNote={ الاجماع الفقهي وجود اربع طرق واساليب لوضع الدساتير كلا حسب الظروف التي تمر بها الدولة فهناك الطرق غير الديمقراطية والتي تتمثل بـــ(المنحة والعقد) وهي طرق قديمة جدا لم تعد تستعمل في وضع الدساتير ، وهناك الطرق الديمقراطيـــة وهي ( الجمعيــــة التأسيسية  والاستفتاء الدستوري ) وهي طرق تتلائم مــــع مبادىء الديمقراطية ، ولكن وبعد بروز اهمية المعاهدات الدولية في وضع دساتير بعض الدول التي تمر بظروف استثنائيـــة كالحروب والاحتلال وكـــــــذا الحال الدول الفيدرالية والتي ينشىء فيها الاتحاد الفيدرالي بموجب الدستور الفيدرالي الاتحادي الــــــــذي يحكم كل الاعضاء  في الاتحاد الفيدرالي ، هنا صار لزاما على فقهاء الدستور الاعتراف بوجود اسلوب خامس لوضع الدساتير هو اسلوب المعاهدات الدولية . }, number={1}, journal={مجلة المنصور}, year={2025}, month={أغسطس}, pages={102–113} }
